1. Acceptance of Terms

By accessing or using EcomGST (“Services”), you agree to be bound by these Terms and Conditions (“Terms”).

If you do not agree, discontinue use immediately.

2. Description of Services

EcomGST provides GST return preparation, data processing, reporting, and related compliance tools.

The platform assists in preparation and organization of GST data. Final review, validation, and filing responsibility remains with the user.

3. Eligibility & Account Registration

You must be at least 18 years old
You must provide accurate and complete information
You are responsible for maintaining account credentials

4. Free Trial

A 1-month free trial may be provided with full access to features
EcomGST reserves the right to modify or withdraw the trial offer at any time

5. Subscription & Pricing

5.1 Billing

All plans are billed annually
Plans are offered in tiers such as Starter, Growth, and Advance
Each plan has defined client limits

5.2 Upgrades

Users may upgrade to a higher plan at any time
Remaining subscription value will be adjusted as credit toward the upgraded plan

5.3 Downgrades

Downgrades are not allowed during an active billing period
Users may select a lower plan only at renewal

5.4 Client Top-Ups

Users may purchase additional client capacity within their current plan

6. Payments & Refund Policy

Payments are processed via third-party payment gateways
EcomGST does not store full payment credentials

Refund Policy:

All payments are non-refundable
No refunds will be issued for unused time or partial usage
Exception: Upgrade adjustments as defined above

7. User Responsibilities

You agree:

To provide accurate GST and financial data
To review all outputs before filing
To use the platform only for lawful purposes
Not to upload false, misleading, or illegal information

You remain responsible for:

Compliance with GST laws
Accuracy of filings
Any penalties, notices, or consequences arising from submitted data

8. System Role & Professional Disclaimer

EcomGST is a software tool designed to assist in GST data preparation and reporting.

The platform does not provide professional, legal, or tax advisory services
Outputs are generated based on user-provided data and system logic
Users must independently verify all data, computations, and filings before submission

EcomGST shall not be interpreted as a substitute for professional judgment or consultation.

9. Account Access & Usage

9.1 Access

Users may access the platform from multiple systems

9.2 Credential Sharing

Sharing login credentials with unauthorized users is strictly prohibited
Violation may result in account suspension or permanent termination

10. Data Access & Ownership

Users retain full ownership of their data
EcomGST does not claim ownership over user or client data
Users may export their data at any time

11. Data Protection & DPDP Compliance

EcomGST processes personal data in accordance with applicable Indian laws, including the Digital Personal Data Protection Act, 2023 (DPDP Act).

11.1 Role of EcomGST

EcomGST acts as a data processor for user-uploaded client data
Users act as data fiduciaries responsible for lawful data collection and usage

11.2 User Obligations

By using the platform, you confirm that:

You have obtained necessary consent from your clients to process their data
You have lawful authority to upload and use such data

11.3 Data Processing

Data is processed only for providing Services
Reasonable security safeguards are implemented to prevent data breaches

11.4 User Rights Support

EcomGST will provide reasonable assistance to users in fulfilling:

Data access requests
Data correction or deletion requests

11.5 Breach Handling

In the event of a data breach, reasonable steps will be taken in accordance with applicable law.

12. Future Features & Integrations

EcomGST may introduce integrations such as GST Portal APIs in the future
Such features may:
- Be optional
- Be part of separate plans or pricing
- Require additional user authorization

13. Communication

By using EcomGST, you agree to receive:

Service-related notifications
System updates
Important account information
Promotional or marketing communications

14. Restrictions on Use

You agree not to:

Attempt unauthorized access to systems or data
Reverse engineer or exploit the platform
Use the service for illegal or abusive purposes
Resell or misuse access in violation of these Terms

15. Suspension of Service

EcomGST may suspend or restrict access if:

There is suspected misuse or abnormal activity
There is violation of these Terms

16. Service Availability

We aim to provide reliable access but do not guarantee uninterrupted service
Temporary downtime may occur due to maintenance or technical issues

17. Limitation of Liability

To the maximum extent permitted by law:

EcomGST shall not be liable for indirect, incidental, or consequential losses
Liability, if any, shall not exceed the amount paid by the user for the Services

18. Modifications to Terms

We may update these Terms periodically. Continued use of the Services after updates constitutes acceptance of revised Terms.
